Savoie Arbitration obtains apparent first ever document production in ICSID annulment proceedings for Peteris Pildegovics and North Star in case against Norway.

We are proud to represent the Claimants in a landmark development in the case of Peteris Pildegovics and SIA North Star v. Kingdom of Norway (ICSID Case No. ARB/20/11). For apparently the first time since ICSID’s inception in 1965, an ad hoc committee has granted document production in an annulment proceeding.

According to Investment Arbitration Reporter (IAReporter), this decision is particularly noteworthy, reflecting the Committee’s nuanced and principled approach to balancing the traditionally narrow scope of ICSID annulment with the need for procedural fairness. The Committee emphasized that “annulment is not an appeal,” yet found that the Claimants had identified sufficiently exceptional circumstances justifying disclosure, particularly regarding potential conflicts of interest and Norway’s engagement with external counsel.

This procedural order may reshape how future ICSID annulment proceedings approach evidentiary matters. Historically, annulment has focused strictly on procedural irregularities. The Committee’s openness to document production marks a potential shift toward greater procedural transparency and due process in ICSID’s post-award review mechanisms.

IAReporter ’s Damien Charlotin has just published an article that the ad hoc committee has dismissed the respondent’s request for security for costs in the annulment proceedings initiated by SIA North Star and Peteris Pildegovics in ICSID Case ARB/20/11 against the Kingdom of Norway, where Savoie Arbitration represents the investor-claimants alongside Professor Mads Andenas KC.

This decision reaffirms that security for costs should not be granted lightly, especially when it could impede access to justice for investors.

The International Centre for Settlement of Investment Disputes (ICSID) has published its Decision on the Stay of Enforcement of the Award in the ongoing arbitration case where Savoie Arbitration serves as Lead Counsel for the Applicants Peteris Pildegovics and SIA North Star against Kingdom of Norway, No. ARB/20/11.

In this decision, the Committee granted the Applicants’ request for a continuation of the stay of enforcement.

An article by Giovanni Dall’Agnola, published yesterday in Investment Arbitration Reporter IAReporter, delves into this decision, highlighting that the continuation of the stay is conditional on the Applicants’ commitment to ensure payment if the award stands.

Also, the ad hoc committee decided in Procedural Order Nr.1 that Norway is prohibited from receiving assistance from the Wikborg Rein law firm during the Committee’s examination of Applicants’ conflict-of-interest concerns raised as a ground for annulment of the award.

We are proud to highlight the participation of our partner Pierre-Olivier Savoie and Caroline Defois, in the ongoing International Court of Justice (ICJ) proceedings in The Hague from December 2nd to 13th, 2024. These historic hearings address state obligations under international law concerning climate change, with 98 states and 12 international organizations presenting their statements.

On December 3rd, 2024, Pierre-Olivier Savoie, representing the Republic of Cameroon, delivered an oral statement alongside H.E. Madam Madeleine Liguemoh Ondoua, Ambassador Extraordinary and Plenipotentiary of Cameroon to the Kingdom of the Netherlands. This collaboration reflects Cameroon’s commitment to contributing meaningfully to this critical global dialogue on climate accountability and justice.

The proceedings aim to clarify states’ legal responsibilities to combat climate change and the consequences of inaction—an essential step toward shaping a more sustainable and just future for all nations.

The book « Droit international et violences sexuelles dans les conflits armés » (“International Law and Sexual Violence in Armed Conflict”) under the scientific direction of Bérangère TAXIL, Isabelle Fouchard and Coralie Klipfel is now available for a pre-ordered online (Release date: 16 July 2024).

The books conclusion includes a summary of the round table discussion held at the University of Angers during the biennial session of the Institut du Droit International (IDI) to mark its 150th anniversary themed “strategic litigation in the face of mass crimes” to which our partner Pierre-Olivier Savoie contributed to. During this round table were raised questions of prosecutions, reparations, mass claims, etc., in respect of human rights. Speakers answered these questions by examining the workings of international justice, the powers of States, the strategies developed by NGOs to ensure justice, and the reparations available to victims.

Bohmer has just reported on the constitution of the ad hoc Committee in annulment proceedings initiated by SIA North Star Peteris Pildegovics in ICSID Case ARB/20/11 against the Kingdom of Norway, where Savoie Arbitration represents the investor-claimants alongside Professor Mads Andenas KC.

The committee is composed of Lucinda Low, Professor Dr. Maxi Scherer and Andrea Bjorklund.

As Lisa M. Bohmer reports: “While all-female panels remain the exception in ICSID arbitrations, this is not the first time that an investor-state claim is heard by three women: the first all-female ICSID ad hoc committee was constituted in March 2021 in Cementos La Union v. Egypt, while the first all-female ICSID tribunal was formed a few months later, in Quanta Services v. Peru. Outside of the ICSID context, three women had previously been named to hear the Webuild v. Dominican Republic UNCITRAL arbitration.”
